When does a minor student need a custodian in Canada?

Immigration, Refugees and Citizenship Canada says a child under 17 who studies in Canada without an accompanying parent or legal guardian must have a custodian in Canada. A custodian may also be requested for a student aged 17 or older, depending on the immigration officer's assessment. Ontario's age of majority is 18.

A custodian must be a responsible adult who is a Canadian citizen or permanent resident and who can care for and support the student. Families should check the current IRCC guidance and the student's school or school board requirements before relying on any checklist.

What custodianship support can Maple Study Link provide?

  • communicating with the school and attending parent meetings where authorized;

  • following up on learning progress and sharing agreed updates with parents;

  • helping a student navigate access to medical services and related paperwork.

The exact duties, response times, geographic coverage, fees and exclusions must be written into the service agreement before a family enrols.

What documents are used to appoint a custodian?

IRCC uses the Custodianship Declaration form IMM 5646. IRCC's current instructions say the custodian signs and has the first page notarized in Canada, while the parent or legal guardian signs and has the second page notarized in their home country.

Requirements can change and individual cases differ. Families should use the current IRCC form and instructions, and obtain qualified legal or immigration advice when their situation calls for it.

How should parents compare custodianship services?

Ask each provider to confirm who will be the named custodian, whether that person meets the current IRCC conditions, how close they are to the student's home and school, what happens in an emergency, what school communication is included, and how the agreement can be changed or ended. Compare the written scope rather than relying on a general promise.
